The customer is expressly prohibited from passing on the property documentation and property information to third parties without the express prior consent of the estate agent. If the customer breaches this obligation and the third party or other persons to whom the third party has passed on the information conclude the main contract, the customer shall be obliged to pay the commission agreed with him plus VAT.<\/p><p><strong>\u00a7 2 Dual activity<\/strong><br \/>The broker is entitled to work for both the seller and the buyer and is liable to pay commission.<\/p><p><strong>\u00a7 3 Owner information<\/strong><br \/>The broker points out that the property information passed on by him originates from the seller or from a third party commissioned by the seller and has not been checked for accuracy by him, the broker. It is the client&#8217;s responsibility to check the accuracy of this information. The broker, who merely passes on this information, accepts no liability for its accuracy.<\/p><p><strong>\u00a74 Limitation of liability<\/strong><br \/>The broker&#8217;s liability shall be limited to grossly negligent or intentional conduct, provided that the customer does not suffer physical injury or lose his life as a result of the broker&#8217;s conduct.<\/p><p><strong>\u00a7 5 Prevention of money<\/strong> laundering<br \/>We are obliged to determine and store the identity of the contracting parties, their representatives and beneficial owners when initiating a specific purchase contract as part of the prevention of money laundering in accordance with the German Money Laundering Act (GWG). Our contractual partners are obliged to support us in fulfilling this legal obligation in accordance with \u00a7 11 GWG.<\/p><p><strong>\u00a7 6 Statute of limitations<\/strong><br \/>The limitation period for all claims for damages by the client against the broker is 3 years. It shall commence at the time at which the act giving rise to the obligation to pay damages was committed. Should the statutory limitation regulations lead to a shorter limitation period for the broker in individual cases, these shall apply.<\/p><p><strong>\u00a7 7 Place of jurisdiction<\/strong><br \/>If the broker and the client are registered traders within the meaning of the German Commercial Code, the place of performance for all obligations and claims arising from the contractual relationship and the place of jurisdiction shall be the registered office of the broker.<\/p><p><strong>\u00a7 8 Consumer arbitration<\/strong> board<br \/>The European Commission provides a platform for online dispute resolution at <a href=\"http:\/\/ec.europa.eu\/consumers\/odr.\">http:\/\/ec.europa.eu\/consumers\/odr.<\/a> Consumers can use this platform to settle their disputes.
